1. Introduction
Welcome to Fixed Price Dental (“we”, “us”, “our”), operated by Fix’d Group Pty Ltd (ABN 98 641 429 987). Fixed Price Dental is an online dental booking marketplace that connects patients with dental practices across Australia. By accessing or using our website at fixeddental.com.au and any associated applications (the “Platform”), you agree to be bound by these Patient Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Platform.
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Platform with a revised effective date. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
2. About the Platform
Fixed Price Dental is a marketplace platform that allows you to search for dental practices, view available appointment times, and book dental appointments. We also send appointment reminders via email and SMS on behalf of dental practices.
Fixed Price Dental is not a dental provider. We do not provide dental advice, diagnosis, treatment, or any healthcare services. The dental practices listed on our Platform are independent businesses and are solely responsible for the dental services they provide to you. Any relationship you form with a dental practice through our Platform is between you and that practice.
3. Eligibility
To use the Platform, you must be at least 18 years of age. If you are under 18, a parent or legal guardian may use the Platform on your behalf to book dental appointments for you. By using the Platform, you represent and warrant that you meet these eligibility requirements.
4. Account Registration
You may need to create an account to use certain features of the Platform. When creating an account, you agree to provide accurate, current, and complete information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect any unauthorised use of your account.
5. Booking Appointments
When you book an appointment through the Platform, you are making a booking request with the relevant dental practice. While we facilitate the booking process, the confirmation and fulfilment of your appointment is the responsibility of the dental practice.
You agree to attend any appointments you book. If you need to cancel or reschedule, please do so as early as possible through the Platform or by contacting the dental practice directly. Dental practices may have their own cancellation policies, including cancellation fees, which are separate from these Terms.
6. Reminders
We may send you appointment reminders via email and/or SMS. These reminders are provided as a courtesy and we do not guarantee their delivery or accuracy. It is your responsibility to keep track of your appointments. You may opt out of reminders at any time by following the unsubscribe instructions in the relevant communication or by contacting us.
7. Your Obligations
When using the Platform, you agree not to: use the Platform for any unlawful purpose or in violation of any applicable law; provide false, misleading, or inaccurate information; interfere with or disrupt the operation of the Platform or its infrastructure; attempt to gain unauthorised access to any part of the Platform; use the Platform to harass, abuse, or harm dental practices or other users; or use automated tools, bots, or scrapers to access or collect data from the Platform without our prior written consent.
8. Intellectual Property
All content on the Platform, including text, graphics, logos, icons, images, software, and design elements, is the property of Fixed Price Dental or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any content on the Platform without our prior written consent.
9. Disclaimer of Warranties
The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not endorse, guarantee, or assume responsibility for the quality, safety, or suitability of any dental services provided by practices listed on the Platform.
10. Limitation of Liability
To the maximum extent permitted by Australian law, including the Australian Consumer Law, Fixed Price Dental shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform.
Fixed Price Dental is not liable for any acts, omissions, negligence, or misconduct of any dental practice listed on the Platform. Any disputes regarding dental treatment or services must be resolved directly with the relevant dental practice.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.
11. Indemnification
You agree to indemnify, defend, and hold harmless Fixed Price Dental, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your breach of these Terms, or your violation of any applicable law or the rights of any third party.
12. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. You may stop using the Platform and close your account at any time by contacting us. Upon termination, your right to use the Platform will immediately cease.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any disputes arising out of or in connection with these Terms or your use of the Platform.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
